Our complete terms and conditions (Terms) are contained below and in our policies, but some important points for you to know before you become a customer are set out below:

• Order Confirmation: You'll receive an email confirmation once you place an order, but this doesn't mean it's accepted. A contract is formed only when we confirm we have accepted your order and received your payment.
• Order Changes: Orders cannot be changed once we start processing your order. Review your order carefully before submitting.
• Warranties: Products may come with guarantees under the Australian Consumer Law, entitling you to a replacement or refund for major failures.
• Website Use: Unauthorised use, copying, or commercial distribution of website content is not permitted.

Nothing in these Terms limits your rights under Schedule 2 of the Competition and Consumer Act 2010 (Cth) (Australian Consumer Law).

2. Introduction
This website (website) is operated by Chic Sips Pty Ltd (ACN 688 752 025) (Chic Sips, we, our or us). These Terms are a contract between us and you (the person placing an order for products through the website) and include the following policies available on our website:

3. Pricing
All prices are in Australian dollars and include GST unless stated otherwise. We reserve the right to update pricing at any time before you place an order. Prices do not include shipping, which will be calculated at checkout.

4. Placing an order
Once you place an order, you'll receive an order confirmation email. This confirms we’ve received your order, but it doesn’t mean it’s accepted. We may cancel or refuse orders where stock is unavailable, payment is not approved, or there’s an error in pricing or product details. A contract will not be formed until we confirm acceptance of your order (for example, by sending you a shipping confirmation email or otherwise fulfilling your order). Only the products listed in the acceptance confirmation are included in the contract formed between you and us.

Orders cannot be changed or cancelled once we’ve accepted your order (although we will try our best to assist you where we can). Please review your order carefully before submitting it to ensure all details are correct.

Our products are supplied for domestic and personal use only. They must not be used for commercial resale or other commercial purposes.

5. Product description
We do our best to ensure all details, descriptions and prices of the products displayed on this website are accurate. However, errors may occur in relation to such details, descriptions and prices. If we discover an error in relation to any products you have purchased, we will do our best to correct it as soon as we can.

6. Product availability
All purchases made through the website are subject to availability. We do our best to keep product availability accurate. If something becomes unavailable after you’ve placed your order, we’ll be in touch quickly to offer an alternative piece, a store credit (gift voucher) or a refund — whatever works best for you.

7. Pre-orders
Some products may be available to purchase on pre-order. Estimated dispatch timeframes will be shared clearly at the time of ordering. For full details, refer to our Pre-Order Policy.

8. Shipping
Shipping timeframes vary depending on location and product availability. Estimated delivery dates are provided as a guide only and are not guaranteed. For more, see our Shipping Policy.

9. Returns and change-of-mind
We accept change-of-mind returns within 14 days of delivery, with the refund provided as a digital gift card, provided products are unused, in original condition, and returned with all packaging and proof of purchase. For faulty or damaged products, your rights are protected under the Australian Consumer Law. See our Returns Policy for details.

10. Gift cards
Chic Sips gift cards are valid for 3 years from date of issue. They are non-refundable and cannot be redeemed for cash.

11. Ownership
Ownership in the products you have purchased does not pass to you until payment has been received in full. Risk in the products (including loss or damage) passes to you upon delivery.

12. Intellectual property
Chic Sips®, Can Couture® and Bottle Couture® are registered trademarks of Chic Sips Pty Ltd in Australia. Trademark registration for Chic Sips is pending in China.

Where applicable, the specifications and design of our products (including all intellectual property rights such as copyright, design rights, trademarks and other rights) remain our property. This includes, without limitation, original product designs, patterns, artwork, packaging, photography and other creative materials appearing on this website or in our products.

You must not use our intellectual property for commercial purposes, including, for example, to advertise your own business, for resale, or for any other revenue-generating activity.

You must not, without our prior written consent:

• copy, in whole or in part, any of our intellectual property;
• reproduce, retransmit, distribute, disseminate, sell, publish, broadcast or circulate any of our intellectual property to any third party; or
• breach any intellectual property rights connected with the website or the products, including altering or modifying any of our intellectual property; causing any of our intellectual property to be framed or embedded in another website; or creating derivative works from any of our intellectual property.

13. Australian Consumer Law
If the Australian Consumer Law applies, then:

• Our goods may come with guarantees which cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage.
• You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.

14. Limitation of liability
We trust you will enjoy your purchase. In the unlikely event that an issue arises, the following terms outline our respective responsibilities.

We do our best to provide accurate product information and fulfil every order as promised. That said, to the extent permitted by law, we won’t be liable for any loss arising from the use of this website or from delays, errors or interruptions beyond our control (including natural disasters, strikes, pandemics or supply chain disruptions).

We are not liable to the extent that failure of the products is caused by you or a third party’s negligent or wilful act or omission.

Except for liability for personal injury (including sickness and death) and as otherwise provided in these Terms, to the extent permitted by law, we are not liable for any indirect or special loss or damage suffered or incurred by you in relation to the products or services supplied under these Terms.

We do not attempt to exclude or limit liability under the Australian Consumer Law or any other applicable law, where such exclusion or limitation is not permitted by law. To the extent permitted by law, any other condition or warranty which would otherwise be implied into these Terms is excluded.

In all other cases, our total liability for loss or damage of any kind, whether arising under Terms or arising in any other way out of or in connection with the supply, sale, delivery or performance of the products, whether in tort, contract or otherwise, is limited to the amount paid by you to us for the products.

15. Using our website
All content on this website, including images, logos, designs and text, is owned by Chic Sips and protected under intellectual property laws. You're welcome to browse and shop, but any unauthorised use, copying or commercial distribution is not permitted.

You must not use the website and/or place an order for products through the website unless you are at least 18 years old.

When using the website, you must not do or attempt to do anything that is unlawful or inappropriate, including:

• anything that would constitute a breach of an individual’s privacy or any other legal rights;
• using the website to defame, harass, threaten, menace or offend any person;
• using the website for unlawful purposes;
• interfering with any user of the website;
• tampering with or modifying the website (including by transmitting viruses and using trojan horses);
• using the website to send unsolicited electronic messages;

17. Dispute Resolution
If a dispute arises between you and us in relation to your purchase, the parties will first attempt to resolve the dispute through good faith negotiations.

If the dispute cannot be resolved through negotiations within thirty (30) days, either party may refer the dispute to mediation in accordance with the rules of the Resolution Institute Ltd (ACN 008 651 232) and any successor or replacement.

The above dispute resolution requirements do not apply where a party is seeking urgent injunctive or interlocutory relief.

18. Applicable laws
The terms in this document and in our policies are subject to the provisions of the Australian Consumer Law and any other non-excludable guarantees or rights required by Australian law. Nothing in this document is intended to exclude, restrict, or modify your rights under the Australian Consumer Law or any other non-excludable legislation in Australia.

19. No Third-Party Rights
No one other than you or us have the right to enforce any of the Terms.

20. Transfer of Rights
We may transfer our rights under these Terms to another business without your consent, provided this does not adversely affect your rights. You must not transfer your rights without our prior written consent.

21. Severability
If any part of these Terms is found to be invalid or unenforceable, the remaining terms will continue in full force.

22. Entire agreement
These Terms and the policies referred to above constitute the entire agreement between you and us and replace any prior agreements or understandings. If there is any inconsistency between these Terms and the policies, these Terms prevail to the extent of the inconsistency.

23. Governing law
These Terms and our policies are governed by the laws in force in the State of Victoria, Australia. You agree to submit to the exclusive jurisdiction of the courts of that jurisdiction.

The website may be accessed in Australia and overseas. We make no representation that the website complies with the laws (including intellectual property laws) of any country outside of Australia. If you access the website from outside Australia, you do so at your own risk and are responsible for complying with the laws in the place you access the website.

24. Changes to Terms
We may make changes to these Terms and our policies at any time. Any changes will be effective immediately upon posting to our website. For any order that has been accepted by us, the Terms and the policies that apply will be the ones that were in effect (and which you agreed to) when you placed your order.
